Terms
BY PURCHASING FROM US, YOU AGREE TO THESE TERMS AND CONDITIONS. No other terms shall apply except as agreed in writing signed by us. We reserve the right to correct typographic errors and reject orders.

Prices and Payment
Prices, title and risk of loss are F.O.B. Monterey, CA. Prices don't include taxes, shipment, or handling and may be changed without notice. Visa and Master Card accepted for net invoice amount. Credit card arrangements subject to change. Open accounts available on approval after placing your first order. All payments in US Dollars only.

Returns
Xit 404 will accept return orders with an RMA number. If shipment appears damaged on receipt have the carrier mark this on the bill and contact Xit 404.

Refunds
Xit 404 will refund any order after receiving its goods minus shipping and handling charges. Refunds will be in US Dollars.

Cancellation
Orders can be cancelled prior to shipment. After this point call for an RMA and return the product. Xit 404 will refund the cost of the products minus the shipping and handling costs.

Limited Warranty
Our only warranty obligation is to replace any item proved defective in material or workmanship. ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, ARE DISCLAIMED.

Liability
WE SHALL NOT BE LIABLE IN CONTRACT, WARRANTY, TORT OR OTHERWISE FOR CONSEQUENTIAL, SPECIAL, EXEMPLARY OR INCIDENTAL DAMAGES. IN NO EVENT SHALL OUR LIABILITY EXCEED THE PURCHASE PRICE. ENFORCING THE LIMITED REPLACEMENT RIGHTS IS YOUR EXCLUSIVE REMEDY.

Obligations
You warrant, represent and agree: (1) to comply with all laws; (2) that our sale and shipment of the product will not, by export thereof, your legal status or otherwise, cause us to violate any law; and (3) to indemnify us against any losses from a failure by you or a third party to comply with law or these terms and conditions, or from use of the product.
